La professeure Julia Hernandez présentera les résultats préliminaires d'une recherche sur l'impact de la pratique militante du droit dans l'affaire Caring Society c. Canada et sur les leçons que pourraient en tirer les mouvements américains qui contestent le système de réglementation de la famille. Tant aux États-Unis qu'au Canada, de vastes critiques de l'implication disparate des familles autochtones et d'autres familles de couleur ont percolé au premier plan des conversations nationales sur la justice sociale et raciale. L'affaire Caring Society a donné lieu à un jugement historique selon lequel le Canada a fait preuve de discrimination à l'égard des enfants des Premières Nations et de leurs familles en sous-finançant les services à l'enfance.

The Human Rights Research and Education Centre (HRREC) is pleased to invite you to this presentation with Julia Hernandez, Associate Professor of Law at the CUNY School of Law and holder of the Fulbright Canada Research Chair in Human Rights and Social Justice at the HRREC this Winter 2022: Movement Lawyering in the Caring Society Case

Professor Julia Hernandez will present preliminary research findings on the impact of movement lawyering in Caring Society v. Canada and what U.S.-based movements challenging the family regulation system might learn from it. In both the U.S. and Canada, broad critiques of the disparate involvement of indigenous families and other families of color have percolated to the forefront of national conversations around social and racial justice. The Caring Society case resulted in a landmark ruling that Canada discriminated against First Nations children and their families by under-funding children’s services.
