Intellectual Property
Overview of intellectual property
An introduction to intellectual property -- what it is and how you
protect it. Patents, designs, trade secrets, trademarks, copyright and
plant breeder's rights will be introduced and discussed to point out the
advantages and limitations of each form of protection
Detail on patents
A more in-depth look at patents -- why we have a patent system, an
overview of what is patentable and the process for preparing a patent
application -- what type of material should be included, the importance
of the claims and the importance of support for fall-back positions.
Patent searches
This class will cover the various types of patent searches including
novelty, validity and freedom to operate searches. This session will
also cover 'reading' a patent application to determine the nature and
limits of the protection and how different parts of the patent are read
when determining novelty versus determining freedom to operate.
Reading claims and ownership/inventorship determinations
An in depth analysis of what is protected by the claims of a patent and
what isn't. The second part will deal with how you determine who is an
inventor and how you determine who owns an invention.
Overview of infringement and validity
An in depth analysis of patent infringement and patent validity with
case studies -- does this patent infringe the claims of this one and is
this patent valid in view of this earlier patent?
Protecting non-patentable subject matter
Industrial designs, trade secrets, traditional copyright protection,
plant breeder's rights. What is and isn't infringment. Software-based
patents, limits of copyright protection on software, what is and isn't
copyright infringement with software, other forms of protection .
Project
Students will be assigned a patent from their area of research and will
prepare a written report on the patent: who are the inventors, who owns
the patent, what other patents they own as means of determining how
important this patent is to the overall patent portfolio of the company,
what the claims protect, and contrasting that with the detailed
description of the patent.
Technology Commercialization
Technology Commercialization Options:
What are the sources of technology and what are the options for
commercialization (sale, license, acquire, new venture formation,
spin-out, etc.)? How should one decide which is the best for the
technology available? The class will explore each of the options. The
class will also start to consider the process for technology
commercialisation and the major factors required for success. What does
the tech transfer office need to successfully market a technology?
Idea Generation and Preliminary Market and Technical Assessment
Technologies and products based on the technology must address market
needs to be adopted by end users. This session will start to build the
business case for a new product and will address various questions
including: How is a determination made that a technology addresses an
unmet need? What is the overall market strength? Is the product
differentiated sufficiently to be adopted? What is the unfair
competitive advantage that will allow the product to capture and defend
market share. Students will discuss preparation of an elevator pitch.
Evaluation of Markets for New Products
A case study examining market need and product potential will be
discussed in class. Students will be evaluated based on their
contribution to discussion of the case, identification and evaluation of
the opportunities and recommendations for courses of action.
Target Product Profiles will be discussed as a tool to determine the
market and technical specifications required for a new product.
Product Development
A market need and a technology with potential to address the need have
been identified. What are the next steps? Development work plan,
personnel requirements, proposed expenditures, investment requirements,
and capital plan. Project Management techniques will be reviewed and a
sample project outline developed for a selected technology.
Sponsored Research and Sources of Capital
Sponsored Research -- How to forge a successful partnership with
business without selling your soul:
Businesses and academic researchers often need each other, but don't
know how to effectively interact. This session will discuss some of the
driving factors for both academic and corporate research and how they
can effectively work together without compromising the ability to
publish or obtain research grants.
Sources of Capital and Case Study -- New Venture Startup:
Examination of various sources of capital: grants, loans, equity
(Friends & family, Angels, Partnerships, Venture Capital) and others. A
case study examining the formation of a new venture to commercialization
technology will be discussed in class. Students will be expected to
review the case, evaluate the challenges facing the new venture, and
propose various options to address those challenges.

Conference / Workshop Announcements and Calls for Papers
New Website that Might be Useful for Graduate Students - The
Graduate Junction <http://www.graduatejunction.com/>
*About*
The Graduate Junction is a brand new site which aims to give research
students an easy way of making contact with others who share their
research interests no matter which department, institution or country
they work in.
This website has been created by two graduate research students, who
felt isolated in the specifics of their respective research projects.
This isolation is briefly relieved at conferences, where student
researchers can meet others who might be interested and doing similar
work. However, conferences are limited and don't happen every week. And
whilst, literature reviews are essential, they can only ever reveal
completed work. Therefore we want to pioneer the first online meeting
place for graduate research students all over the world so that you can
find out what research is currently being done by your fellow students.
The Graduate Junction also has a bold vision to break down disciplinary
and national boundaries that exist in research. Our own experiences have
taught us that research in different subject areas has much overlap.
Therefore, key to The Graduate Junction is your Research Keywords rather
subject area, department or institution.
*The Problem*
Graduates have three sources of information about work done in their
chosen field.
* Published literature
* Conferences and seminars
* Their supervisor
The problem is that literature reviews can only ever reveal completed
work, conferences don't happen every week and supervisors mostly rely on
the same sources as you do. It is very easy to become isolated, overly
focused on the specifics of your own work and lose a sense of what other
related work is being done.
We also noticed that very distinct and separate literatures and
conferences exist for different subject areas when in reality there is
much overlap in the research being undertaken within these areas. For
example, although I am doing a chemistry PhD, my work as a physical
chemist overlaps with areas of physics and chemical engineering. In
Education, experience has shown that there is overlap in many other of
the Social Sciences, such as Human Geography, Sociology, Economics.
*A Solution*
Networking is an essential part of the research process; promoting
collaboration, generating new ideas and preventing duplication of
effort. Consequently, we thought, wouldn't it be great if there was a
common point for graduate researchers in all disciplines, in all parts
of the world to come together and meet others who share their research
interests. And by making Research Keywords central to The Graduate
Junction we hope to break down existing disciplinary boundaries.
We hope you enjoy and benefit from using the site.

Regulating Biopatenting: A Case for Contrast or Convergence?
Friday June 27th 2008
Brocher Center, 471 Rte d'Hermance, 1248 Hermance, Geneva,
Switzerland
Biopatenting is a controversial and central aspect of the most
significant challenges currently facing societies and governments around
the world. It is drawn into alternative energy technology,
waste-management, food production, and public health, to mention a few.
Given the diversity of global perspectives, a unified approach to
biopatent regulation may be difficult to achieve across governance
sectors and in different countries, but of critical importance. Or
perhaps not?
You are invited to join a select group of scholars, policy makers, NGOs,
technology business innovators, and experienced legal practitioners for
this workshop on comparative regulatory policies in biopatenting and
their future. The event will be held from 9:30 am to 4:30 pm on Friday
June 27th 2008, at the Brocher Foundation, and is hosted with the
Foundation's support by Dr. Bita Amani, Assistant Professor of Law from
Queen's University, Canada.
The purpose of this workshop is to bring together a multi and
interdisciplinary group to share perspectives, experiences, and future
projections for biopatent policy and regulatory diversity and to
encourage fruitful discussion on practical issues in operationalizing
policy initiatives for coherent regulation across sectors. In addition,
we hope to promote further pluridisciplinary thinking on the governance
issues related to the ethical, legal, and social implications of
biotechnologies for humanity and society as set out in the mission of
the Brocher Foundation's main current programme. Discussion will focus
on biopatent policies at the intersection of other"sectors of vital
importance" to "socio-economic and technical development" from different
