Lodhi Memorial Lecture in Human Rights, “The Resurgence of Indigenous Law in Canada” with Dr. John Borrows, on Thursday, March 3rd at 7:00 p.m. AST via Zoom. Dr. Borrows is the Canada Research Chair in Indigenous Law and Professor at the University of Victoria Faculty of Law. About the lecture, he says: “Indigenous peoples use law to regulate their affairs and resolve their disputes. Indigenous law functions through standards, principles, criteria, measures, guideposts, tradition, precedent, and processes to provide intellectual and cultural resources for making decisions. “Indigenous law is growing in force and importance and this talk will discuss how and why this is occurring. In the process, legislatures, courts, corporations, law schools and other institutions in Canada are increasingly having to grapple with Indigenous law and Canadian law related to Indigenous peoples. This talk will discuss how Indigenous peoples’ law is an increasingly active force across the land.” Dr. Borrows is the author of books including Recovering Canada: The Resurgence of Indigenous Law (Donald Smiley Award for Best Book in Canadian Political Science, 2002), Canada’s Indigenous Constitution (Canadian Law and Society Best Book Award 2011), Drawing out Law: A Spirit’s Guide (2010), Freedom and Indigenous Constitutionalism (Donald Smiley Award for Best Book in Canadian Political Science, 2016), The Right Relationship (with Michael Coyle, ed.), Resurgence and Reconciliation (with Michael Asch, Jim Tully, eds.), and Law’s Indigenous Ethics (2020 Best Subsequent Book Award from Native American and Indigenous Studies Association, 2020 W. Wes Pue Best Book Award from the Canadian Law and Society Association). He is also the 2017 Killam Prize winner in Social Sciences and the 2019 Molson Prize winner from the Canada Council for the Arts, the 2020 Governor General’s Innovation Award winner, and the 2021 Canadian Bar Association President’s Award winner. He was appointed as an Officer of the Order of Canada in 2020. He is a member of the Chippewa of the Nawash First Nation in Ontario. In recent decades, claims for reparations of historic injustices have amplified, whether in the context of colonial wrongdoing against Indigenous Peoples, reparation for enslavement or compensation for victims of discriminatory laws targeting specific minority groups. Meanwhile, the emergence of transitional justice has sparked the normative development of the right to reparations. Drawing from the cases of Canada and Colombia, this panel will seek to address some of the core legal questions related to the State’s obligation to provide reparations for massive and/or State-sanctioned violations of human rights and breaches of International Humanitarian Law. About the speakers Éloïse Décoste is a Pierre Elliott Trudeau Foundation scholar and a LL.D. candidate at the Département des sciences juridiques of the Université du Québec à Montréal. Her doctoral research investigates the State’s obligation to provide reparation for colonial genocide in the context of ongoing settler colonialism. About the speaker Olivia Smith is an O’Brien Fellow in Residence at the Centre for Human Rights and Legal Pluralism researching in the areas of human trafficking and migration. She has been working on reconciliation issues and now works as the Head of the Sámi Council’s Human Rights Unit. Ms. Nuorgam is the Chair of the UNPFII, elected in 2019 during the 18th session, and is currently conducting her second mandate. Luisa Castaneda-Quintana is a DCL candidate at McGill University's Faculty of Law. She is conducting her research under the supervision of Prof. Victor Muñiz-Fraticelli, focusing on legal pluralism, extractive industries, resistance, and Indigenous Peoples' identity. Specifically, she analyzes how the Wiwa people's interactions with different normative orders in the context of extractivism have transformed their identity and forged various forms of resistance. Dear Friends, The UM Faculty of Law invites you to join us at a virtual Robson Hall for our next Distinguished Visitors Lecture featuring Dr. Helen Duffy, Leiden University Professor of International Humanitarian Law and Human Rights. Dr. Duffy will speak on “The War on Terror: Past, Present and Future…” Abstract The lecture will reflect on 20 years of the ‘war on terror’, key characteristics and implications for human rights and rule of law, and prospects for the future. Through her legal practice (Human Rights in Practice) Prof. Helen Duffy has litigated cases involving violations of human rights in the name of countering terrorism in diverse contexts and across regional and international human systems, and the lecture will illustrate the issues raised by reference to concrete cases and emerging challenges in practice. About Dr. Helen Duffy Dr. Helen Duffy is a Professor of International Human Rights and Humanitarian Law at the University of Leiden and runs ‘Human Rights in Practice,’ a legal practice specializing in international strategic human rights litigation. Helen has brought ground-breaking cases in the European, African, Interamerican and UN systems and intervened in national cases in multiple jurisdictions. Before setting up her practice, she worked for leading NGOs (Legal Director/INTERIGHTS; Counsel/Human Rights Watch; Legal Director/Centro para Accion Legal en Derechos Humanos Guatemala), the Prosecutor’s Office of the International Criminal Tribunal for the former Yugoslavia, Lord Justice Scott’s Iraq Inquiry in the UK and the UK Govt. legal service. Helen has a PHD from the University of Leiden, LLM from University College London and a law degree from the University of Glasgow. She is honorary/visiting professor at Glasgow, Melbourne and American universities and is on the board of several NGOs. About the speaker Professor Esmeralda Thornhill is a lawyer, linguist and pedagogue by training, a lecturer, researcher, anti-racism trainer and writer by experience, and a longtime social justice advocate and community organizer by conviction. Research Associate since 2014 with Concordia's Simone de Beauvoir Institute, she formally retired in 2016 from Dalhousie's Schulich Law School where when appointed first scholar to anchor the unprecedented James Robinson Johnston Endowed Chair in Black Canadian Studies (1996-2002), she became the first African Canadian woman to hold a Tenured Full Professorship of Law in Canada. Seasoned Human Rights scholar-practitioner and founding member of the Congress of Black Women of Canada, she pioneered the first university-accredited course on Black Women's Studies offered in Canada (Concordia, 1983). In 2012 McGill's Centre for Human Rights and Legal Pluralism invited this former Fulbright Fellow to become its first O'Brien Fellow in Residence. Grounded in Critical Race Theory, her teaching, research and scholarship reflect an Afrocentric, anti-racist stance that resolutely addresses the "material reality" which Black people must navigate, nationally and globally. Besides degrees in languages and pedagogy (McGill), law degrees (UQAM, San Diego), post graduate studies in Spain, England and France, and international human rights law internships (UNESCO, Paris; Lawyers' Committee for Civil Rights Under Law, Washington, D.C.), she holds Honorary Doctorates from CUNY and Concordia. She has worked with several regional and international institutions including the American Bar Association Rule of Law Initiative (ABA ROLI) as Project Lead on Trafficking in Persons (Barbados) and with The British Institute of International and Comparative Law Institute (BIICL as National Consultant on Human Trafficking in Guyana). At CARICOM Secretariat she served as Deputy Programme Manager, Free Movement and Labour. She was a Political Specialist at the US Embassy, Barbados, the Human Resources Development Expert for the European Union Delegation to Barbados, a Lecturer at the University of the West Indies in migration studies and served for ten years as an immigration officer, Government of Barbados. She holds a PhD in Political Science and a Master of Business Administration among other qualifications. She is a Past Fellow of the University of Oxford in forced migration. We fully understand that the enduring COVID-19 pandemic keeps causing challenges and unpredictability, which may make planning your travels more challenging than before. As unfortunately the pandemic is still strongly affecting many parts of the world, we have decided to EXTEND THE DEADLINE for paper submission until January 20, 2022. The meeting is being organized as a physical event and we very much hope to see you all in Denver in-person. Should you not be able to travel due to a government issued travel restriction, or similar official action, there will be a way to accommodate your participation virtually. Your participation is very important for us, not only for the sake of this conference, but also in order to for us to secure the continuation of these meetings where we can all meet one another in the future. At our end, we are working hard together with the venue in Denver to make the event not only a great success, but most importantly safe for everyone to attend. The sooner you register, the better we can review our options regarding the specific needs of an in-person meeting in the current circumstances and determine how we can better scale the event to suit the in-person attendance level. With AirBnB, Vrbo, and dozens of discount services, it is tempting to take advantage of them to save money when attending the WSSA. Aside from the many nightmare stories that have come to light in the last three years, there are several compelling reasons to stay at Hilton Denver City Center. Many downtown properties in Denver have already filled, and finding a room from March 30 to April 2 will be nearly impossible. Saving a little money could be quite costly and result in picking up a few dollars now only to lose c-notes later. Many attendees might not realize it, but there is an even more important reason to stay at the Hilton Denver City Center. Attendees’ stays at the conference hotel make it possible for us to put on the conference. The room block reserved for the conference is basically part of a trade-off for the event space for conference. We use over two dozen meeting rooms at our annual meeting. We get these meeting rooms at reduced charge or no charge to the WSSA only if we fill a certain number of guestrooms, which is specified in the contract with the hotel. If we do not fill the guestrooms, we pay a huge penalty--in the tens of thousands of dollars fyi. This is standard practice in the hotel industry. In several cases in the past, our failure to meet our room quota resulted in huge penalties that the WSSA had to pay. A low room take also makes it difficult for us to book hotels for future years because prospective hotels demand evidence of past room takes. When attendees stay at other hotels, AirBnBs, or Vrbos etc., the hotel suffers, but the WSSA suffers more. It is important that all attendees rent rooms at the conference hotel. Otherwise, the WSSA will be seriously impacted by the financial burden of the penalties. Of course, you can choose not to stay at the conference hotel, but will there be a future WSSA conference for you to attend? In short, decide stay at the Hilton Denver City Center. The WSSA can benefit even from stays of one or two nights in the conference hotel. Thank you.
